1. Acceptance
By downloading, installing, or using the Circa Ailarm application ("App"), you agree to these Terms of Service ("Terms"). If you do not accept these Terms, do not use the App.
2. Description of Service
Circa Ailarm is a personalized smart alarm application based on circadian rhythm and sleep science. The App provides a pre-wake audio/visual signal, personalized morning briefings, chronotype-based settings, and wake-up mechanisms.
3. IMPORTANT — Alarm Reliability and Disclaimer
Circa Ailarm is not a reliable standalone tool for critical situations. Due to mobile operating system behavior (especially Android power saving, battery optimization, and manufacturer restrictions such as MIUI/HyperOS), notification delays, device shutdown, silent mode, depleted battery, or software errors, the alarm may fail to ring or may be delayed.
For situations where missing the alarm could have serious consequences — such as flights, trains, or important appointments — do not rely on a single alarm; use a backup wake-up method. We are not liable for any direct or indirect damages arising from the App failing to ring or ringing late.
4. Health Disclaimer
The App is not a health or medical device. The content provided (chronotype assessment, sleep/wake suggestions) is for general informational purposes and does not replace medical advice. Consult a healthcare professional for sleep disorders or health concerns.
5. License to Use
We grant you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes. You may not reverse-engineer, attempt to access the source code, copy, distribute, or create derivative works of the App.
6. Intellectual Property
All intellectual property rights in the App, including the "Circa" and "Ailarm" brands and names, design, logo, audio content, and software, belong to Ceyhan Girca.
7. Subscriptions and Payments
Certain features of the App ("Premium") require a paid subscription.
Welcome period: When you first start using the App, you receive free access to all Premium features for a limited time, with no payment method or card required. This period is tracked locally on your device.
Free trial and subscription: After the welcome period, Premium access is provided through a paid subscription started via the App Store (Apple) or Google Play. The subscription may include a free trial. Unless canceled at least 24 hours before the trial ends, the subscription fee will be charged to your store account.
Auto-renewal: Subscriptions renew automatically at the end of each period unless canceled at least 24 hours before the current period ends. The renewal fee is charged to your store account within 24 hours prior to renewal.
Pricing: Current subscription prices are displayed in the store screen before purchase. Prices may vary by country/region. Price changes are communicated in advance in accordance with applicable store policies.
Platform differences: Available Premium features may differ between platforms (Android/iOS) due to operating system restrictions. The features offered on your platform are indicated on screen before purchase.
Cancellation: You may cancel your subscription at any time via your App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period; Premium access continues until then. Deleting the App from your device does not cancel your subscription.
Refunds and withdrawal: Payments are processed by Apple and Google; refund requests are subject to the respective store's refund policies and must be submitted directly to Apple/Google. Where performance of digital content begins immediately with your consent, statutory exceptions to the right of withdrawal may apply under applicable law. Your statutory consumer rights remain unaffected in all cases.
8. Third-Party Services
The App uses third-party services such as OpenAI (TTS) and OpenWeather (weather). We are not responsible for the availability or content of these services.
9. Limitation of Liability
To the maximum extent permitted by applicable law, we are not liable for indirect, incidental, special, or consequential damages arising from the use or inability to use the App. The App is provided "as is" and "as available."
10. Changes
We may update these Terms from time to time. Continuing to use the App after a change means you accept the updated Terms.
11. Termination
We reserve the right to terminate your license if you breach these Terms. You may end your use at any time by removing the App from your device.
12. Governing Law
These Terms are governed by the laws of the Republic of Türkiye. The courts and enforcement offices of Istanbul shall have jurisdiction over disputes. Users protected by EU consumer law retain their mandatory consumer-protection rights under the laws of their country of residence.
